1. Introduction

Welcome to GuestBuddy. These Terms and Conditions ("Terms") govern your use of our services, including our mobile application, web platform, and related services (collectively, the "Service") provided by GuestBuddy AB ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Acceptance of Terms

By creating an account, downloading our app, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 16 years old to use our Service. If you are under 16, you may not use the Service without the consent and supervision of a parent or legal guardian.

3. Account Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate, current, and complete
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Not share your account login credentials with any other person

Account Sharing Prohibited: Sharing your account login credentials with others is strictly prohibited. Each account is intended for use by a single individual only. Violation of this policy may result in immediate account termination.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Use of Service

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Resell or redistribute any part of the Service
• Accept payment or compensation of any kind in exchange for writing reviews of venues or companies on the platform

Prohibited Review Practices: Users are strictly prohibited from accepting any form of payment, compensation, or incentive in exchange for writing reviews of venues or company pages. All reviews must be genuine, unbiased, and based on actual user experiences. Violation of this policy may result in immediate account termination and removal of all reviews.

5. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content for the purpose of operating and providing the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to grant us the license described above.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by GuestBuddy AB and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

7. Payment Terms and Ticket Sales

If you purchase a subscription or other paid service, you agree to pay all fees associated with your purchase. All fees are non-refundable unless otherwise stated or required by law.

Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time, but you will continue to have access until the end of your current billing period.

Ticket Sales and Refunds: We do not offer refunds on any tickets bought through our app. No ticket can be refunded if it has been used. All ticket sales are final.

Venue Rules and Policies: We are not responsible if you purchase a ticket and do not gain entry to an event due to your failure to comply with the venue's rules and policies. It is your responsibility to familiarize yourself with and comply with all venue rules, policies, and requirements before purchasing tickets or attending events.

Ticket Pricing: We are not responsible for ticket prices displayed in the app. All ticket prices are set by the venues (companies) themselves through their accounts in the app. We act solely as a platform facilitating the sale of tickets, and we do not control, set, or influence ticket prices.

We reserve the right to change our pricing at any time. We will provide notice of any price changes at least 30 days in advance.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Service Disclaimers and Limitation of Liability

Service Provided "As Is": The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

No Warranties: We make no representations or warranties regarding the accuracy, reliability, or availability of the Service, or the content, products, services, or information available through the Service. Your use of the Service is at your own risk.

To the maximum extent permitted by law, GuestBuddy AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Account Closure for Misconduct: If you are using violence, engaging in threatening behavior, or attempting to take advantage of the app in any way, we are allowed to close your account immediately without prior notice or appeal. This decision is final and there is no right to appeal or override our decision in such cases.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Acceptance of Changes: Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you continue to use the app after the Terms have been updated, you are agreeing to be bound by the new Terms.

Rejection of Changes: If you do not agree to the modified Terms, you must stop using the service and delete your account. Your only recourse if you do not agree with the updated Terms is to discontinue use of the Service and delete your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Gothenburg, Sweden.
